By using weinfreaks.de you entrust us with personal data. Personal data is any information that is capable of identifying a natural person. Partial information which, together with other partial information, can lead to the identification of a person is also personal data.

Common rights

The legal basis for the processing of your personal data is Article 6 (1) of the General Data Protection Regulation 2016/679 of the European Union.

In principle, we only process your data at your instigation and with your express or implied consent. Exceptions are cases in which we cannot obtain your consent in advance or your consent is not required for legal reasons. You can revoke your consent to the processing of your personal data at any time. An informal e‑mail is sufficient for this purpose.

We provide you with a function for deleting or locking your data within your user account within the provisions in section 2.12 of our General Terms and Conditions. In addition, you can also contact us directly with your request for deletion or locking.

Data collection

We only collect, store and process data to the extent necessary to provide our services. To create a user account, this is at least your full name and your e‑mail address. To check your commercial status or to create an invoice for you, we need your postal address. If you use our paid services, we store additional data, such as the duration of your subscription.

As a matter of principle, we do not pass on your personal data to third parties, unless the transfer of data is necessary for the provision of one of our services. In this case, we will obtain your consent. An exception to this rule is when we are legally obliged to hand over data, for example to prosecution authorities.

In principle, we only store your personal data for as long as we need it to provide our services or for legal reasons.

Your IP address

The contentious issue of whether IP addresses are personal data has been affirmed at the latest since the rulings of the European Court of Justice of 19 October 2016, C-582/14, and the German Federal Court of Justice of 16 May 2017, VI ZR 135/13. We therefore generally process your IP address anonymously.

This applies in particular in connection with the analysis software Matomo which we use to create anonymised user profiles for statistical purposes, naturally in accordance with the data protection regulations applicable in the European Union and the Federal Republic of Germany.

Only in order to avert dangers we reserve the right to store non-anonymised IP addresses for a period of up to seven days in justified exceptional cases. The legal base for this is the ruling of the German Federal Court of Justice of 3 July 2014, III ZR 391/13.

Hosting

In addition to the content of our website, we also store your personal data on servers of our web hosting provider. We have therefore concluded a contract with

Payment service provider

In order to receive payments from you, we will forward you to a payment service provider. He will receive only the necessary payment details from us, depending on the selected payment means, including your name, the billing and delivery address and the relevant billing data.
